1. Terms & Conditions.
Welcome to Sixteen Creative ("we," "our," or "us"). By accessing our website, purchasing our Wix Studio templates, or hiring us for custom design services, you ("Client," "User," or "You") agree to comply with and be bound by these Terms and Conditions.
A. Wix Studio Products & Services

  • Wix Studio Templates: Our ready-made digital templates are built specifically for the Wix Studio platform. Upon purchase, you receive a secure download link containing the template package and instructions to add the template to your Wix account.

  • Custom Design Services: Tailored design projects are governed by individual project agreements, scopes of work, and timelines established during onboarding.

B. Intellectual Property & Template License

  • Single-Use License: Every template purchased from Sixteen Creative grants you a single, non-exclusive, non-transferable, and revocable Single-Use License to use the template for one (1) active Wix website only (either for yourself or a single end-client).

  • Strict Prohibition of Resale & Redistribution: You may not resell, lease, license, sub-license, redistribute, share, or transfer the template file, code, or any derivative modifications to any third party, marketplace, or template shop.

  • Ownership: All intellectual property rights, design systems, layouts, and assets within the Wix Studio templates remain the exclusive property of Sixteen Creative.

C. Limitation of Liability
Sixteen Creative is not responsible for any platform-wide outages, updates, code deprecations, or technical failures originating from Wix.com or Wix Studio. We shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our templates or services.

2. Refund Policy
Because Sixteen Creative deals in digital goods and creative services, our refund structure is strictly regulated:

  • Wix Studio Templates (No Refunds): Due to the instant digital nature of Wix Studio template deliveries (via downloadable zip files and direct transfer links), all sales are final. There are no refunds, exchanges, or cancellations once the purchase and download link have been processed.

  • Custom Design Deposits: Deposits paid for custom Wix Studio design projects are strictly non-refundable, as they reserve your dedicated space in our production calendar and cover preliminary strategic planning.

 
EU Consumer Compliance Note: In accordance with European Union Consumer Rights Directive (2011/83/EU) and Spanish general legislation for the defense of consumers and users, the right of withdrawal (cooling-off period) does not apply to digital content supplied via non-tangible media if performance (downloading/transferring) has begun with the consumer's prior express consent and acknowledgment that they consequently lose their right of withdrawal.

3. Privacy Policy
Operating from Madrid, Spain, Sixteen Creative complies fully with the General Data Protection Regulation (GDPR) and Spanish data protection laws (LOPD-GDD).
A. Data We Collect

  • Personal & Transaction Data: Name, billing address, email address, and payment confirmation details processed via secure payment gateways (e.g., Stripe, PayPal, or Wix Payments).

  • Technical & Usage Data: IP address, browser details, and device identifiers gathered via cookies when interacting with our website.

B. Purpose of Data Processing
Your information is handled strictly for the following purposes:

  • Fulfilling digital template delivery or managing custom design contracts.

  • Providing technical support or customer service regarding your Wix Studio assets.

  • Fulfilling statutory Spanish tax, invoicing, and accounting requirements.
